I, James Brookens of the Town of Glen Haven, County of Grant and State of Wisconsin, being of sound mind and memory, and mindful of the uncertainties of human life, do make, publish and declare this my last will and testament, in the manner following;
First, after the payment of my just debts and funeral expenses, I give, devise and bequeath to my second wife Maria the management of all my estate, both real and personal until the youngest of my children hereinafter named and living, until that time, shall arrive at the age of his or her majority, giving to my said wife the income there.
Second, I give, devise and bequeath to my children as follows, to Thomas Brookens, Joseph Brookens, Jeremiah Brookens, Elisabeth Wimer, wife of Samuel Wimer, and Mary Margaret Zeigler, wife of George Zeigler, each the sum of five dollars;
Third, I do hereby give, devise and bequeath to my children hereinafter named to wit: James Wesley Brookens, Columbus Brookens, Samantha Brookens, Ann Eliza Brookens, Elmira Brookens, Olive Adeline Brookens and Emma Brookens at the time of the youngest then living, arriving at the age of his or her majority, my entire estate, both real and personal in equal shares, share for share, subject nevertheless to the statutory provisions relating to the widow/dower if at that period my said wife Maria shall be living;
Fourth, the second bequest is hereby ordered and devised to be paid in six months after the admission of this will to probate;
Fifth, Columbus Brookens and James Wesley Brookens named in bequest number three having each built a house and made other improvements on real estate of which I am seized and at their own cost, and I do hereby declare the true intent and meaning of bequest to them to be, that in the division of my real property, due consideration shall be made and had for their said improvements, and this will shall not be construed to interfere with or device and dispose of the improvements which are their own.
In witness of all which I have hereunto set my hand and seal this 19th of August, A.D. 1879.
The above document will is on one sheet of legal cap paper, was signed published and declared by the testator to be his last will and testament in our presence who have signed our names as witnesses at his request, in his presence and in the presence of each other.
